These terms are an agreement between you and Vladyslav Tsyndrin, an individual based in Lviv, Ukraine ("we", "us"), who provides the Domivka app, the tenant portal at my.domivka.site and related services (together, "Domivka"). By using Domivka you accept these terms. If you don't accept them, don't use Domivka. How we handle data is described in the Privacy Policy.
Domivka helps landlords keep track of properties, tenants, leases, payments, utilities, expenses and documents. It works on your iPhone without an account. Signing in adds cloud sync and the tenant portal for Domivka Pro subscribers.
You must be at least 18 and able to enter into a contract. Keep access to your device and Apple Account secure: whoever has that access can reach your data. You can delete your account at any time in Settings → Account.
What you enter belongs to you. You give us only the permission needed to store, sync and show it so that Domivka works, and only for as long as that's needed.
You are responsible for the data you enter about other people, such as tenants, guarantors and contacts. You must have a lawful basis for processing it under the data protection law that applies to you (for example, the GDPR), and you must tell those people how you use it.
A tenant portal link gives whoever has it access to the lease summary you chose to share. Send it only to your tenant and revoke it if it reaches anyone else. Payment claims and meter readings that tenants send through the portal come from them. Check them before you rely on them.
Domivka is a bookkeeping tool. Calculations, exchange rates, reports, receipts and reminders are provided for your convenience and may contain mistakes. They are not legal, tax, accounting or financial advice. Check important figures yourself or with an expert. Rates come from the National Bank of Ukraine and the National Bank of Poland, and we are not responsible for their accuracy or availability.
Don't use Domivka to break the law, to harass or discriminate against anyone, or to store data you have no right to hold. Don't try to get into other people's accounts, interfere with the service, or copy, decompile or resell it except as the law allows.
Without cloud sync, your data exists only on your iPhone, and losing the phone or deleting the app can lose it. Make regular exports in Settings. We work to keep the online services running but don't promise they will always be available or error-free. We may change or stop features. If we stop a paid feature, we will give reasonable notice and let you export your data.
The app, the website and their design, code and name are ours or our licensors'. You get a personal, non-exclusive, non-transferable licence to use the app on Apple devices that you own or control, as allowed by the App Store terms.
Domivka is provided "as is". To the extent the law allows, we aren't liable for indirect losses, lost profit or lost data. Our total liability is limited to the amount you paid for Domivka in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, such as for intent or gross negligence, or your statutory rights as a consumer.
You can stop using Domivka and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. Where possible, we will warn you first and give you time to export your data.
These terms are between you and us, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation. We, not Apple, are responsible for handling claims about the app, including product liability, failure to meet legal or regulatory requirements, consumer protection, privacy and intellectual property claims. You confirm that you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
These terms are governed by the law of Ukraine. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts. Before going to court, please write to us so we can try to resolve the issue.
We may update these terms. We will update the date above and tell you in the app about significant changes before they take effect. If you keep using Domivka after that, the new terms apply.
